RULES OF THE CLUB

These "Rules of The Club" are hereby established by the Board of Directors of YUMA EAST COUNTRY CLUB, INC. pursuant to the Declarations, Articles of Incorporation, and Bylaws of the Club. Failure to comply with these "Rules of the Club" could result in the suspension of member privileges or loss of membership in the Club without a refund of annual dues.

These Rules and Regulations may be modified from time to time, added to, or deleted as determined necessary by the Board of Directors. If any conflict exists between the provisions of the Declarations, the Articles, the Bylaws, or any amendments thereto, and these Rules and Regulations, the provisions of the Declarations, Articles, or Bylaws shall prevail.
Board Members Hours of availability – Board members are available to conduct Clubhouse business and communicate with members to resolve issues and problems between the hours of 9:00am and 5:00pm. Please respect these hours of operation.
In an emergency after hours please contact a Board member for resolution or guidance.
Definitions
Board - Shall mean the Board of Directors of the Yuma East Country Club (YECC) Corporation.
Bylaws - Shall mean the Bylaws of the Corporation, and such Bylaws may be amended from time to time.
Complaints – A complaint is a statement by a member that a situation or circumstance is unacceptable or unsatisfactory and the member would like the Board to provide a resolution to the issue. Complaints should be presented to the Board in writing.
Violations of rules – A violation of the rules exists when a member ignores, disregards, and/or intentionally or unintentionally does not follow the rules of the clubhouse as defined in this document. Violations should be brought to the attention of the Board and the Board will take the necessary actions to resolve the issue.
Guest / Day Guest - This term will be used for the purpose of defining those visitors who reside outside the boundaries of Yuma East Country Club. Day Guests may live in the greater Yuma area or a neighboring city and are here to spend a day with a YECC member. Day Guests may visit the clubhouse no more than 3 days per month.
Guest / House Guest/Out of Town Guest/Overnight Guest - These terms are used to define a friend or relative of a YECC member who lives outside the Yuma East area and usually from a more remote location and is visiting a Member of YECC. Such a visit requires overnight accommodation whether in the home of a YECC member, some other local home, or in a motel or hotel, or similar business established to provide overnight accommodation. Such Guest shall be limited to Clubhouse use for a stay of (30) days or less.
Member Rules – Only Members and Guests are permitted use of YECC facilities, except during those activities open to the public and as noted in Newsletters, Calendars, or on our list of “Activities & Events” as changed from time to time, i.e., meals offered/open to the public, activities offered/open to the public (Bingo as one example, annual Garage Sale as another), and activities designated as fundraisers by the Board.

Pool & Spa Rules & Regulations
The following rules are hereby established for the use of the POOLS OF THE CLUB.
All pools of the club, including the HOT TUB, shall be used SOLELY AT THE USER'S RISK.
Pools Opening and Closing Times: Pools and the Hot tub are open for use 24 hours a day, seven days a week. There are no lifeguards on duty. To swim alone is dangerous. Swim at your own risk and enjoy yourself, but please be considerate of other people.
Tampering with Pool equipment – Tampering with pool equipment or changing settings of pool equipment may result in a suspension/loss of clubhouse privileges.
Pool temperature settings:
Conversation Pool – 86 degrees,
Lap Pool – 86 Degrees,
Hot tub – 98-102 Degrees.
Temperatures are set per Health and Safety guidelines (No changes to temperatures are allowed. While we attempt to maintain agreeable & comfortable temperatures for everyone, the weather and failure to cover the pool and spa at night will affect the morning temperature of the water.
Only members and their guests are permitted to use the Pool facilities. It is the Member’s responsibility to instruct their guests on the Pool rules and to accompany them, and remain with them, while at a Pool.
Only standard swimwear is allowed. No cut-offs are allowed. Cut-offs can fray and clog filter systems.
Enforcement:
Members shall not try to enforce the rules of the clubhouse on other members.
Violators will be reported to the Board of Directors, who will establish procedures for enforcement and/or revocation of membership. Members shall not try to enforce the rules of the clubhouse on other members. The Board of Directors will determine the need for enforcement and shall exercise all enforcement. Members should report violations of the clubhouse rules to the Board of Directors for resolution.
The Board recognizes that, from time to time, a violation of the established Rules and Regulations, the Bylaws, or the Declarations & Articles of Incorporation may occur, and that a reasonable fine and penalty structure is necessary in such cases to encourage compliance. The Board’s goal is to achieve compliance and not to punish the offender(s). To this end, the Board reserves the right to waive some or all fines and penalties once compliance is achieved.
Filing Complaints for perceived violations of clubhouse rules or for Conduct violations should be done in writing and given to the Board for review and action. Complaint forms can be obtained online on our website or picked up at the front desk. Completed complaint forms can be left at the front desk, put into the YECC mailbox or delivered to a Board member. The Board will review all complaints to see if there is an opportunity for an amicable solution to the complaints.
If a violation (Club Rules or Conduct violation) warrants enforcement action or if the complaint (not a Rules or Conduct violation) cannot be resolved amicably between members, then the violators of will be sent written notification informing them of the violation and that continued violations will result in disciplinary action by the Board.
Any member of the Corporation who violates any Rule or Regulation and/or who causes the Corporation to incur any costs, including legal fees, regardless of whether a lawsuit is filed, is deemed to have violated these Rules, and shall have his/her member privileges suspended or revoked at the sole and absolute discretion of the Board.
Members are responsible for their guests. In addition to a permanent revocation of a guest's privileges, the Corporation reserves the right to simultaneously suspend or revoke a member’s privileges pending a hearing resulting from the actions of a member’s guest and to take any other action against a member resulting from the guest’s actions.
Conduct Violations - Conduct by a member which may be deemed dangerous to other members, or creates a health and safety hazard to members, or unreasonably disturbs others is not permitted on clubhouse property. This includes unusual disturbing or excessive noise; intoxication; arguing or fighting; immoral or illegal conduct; the use of profanity, rude, boisterous, or abusive language; or objectionable conduct in the eyes of the membership and board. Documented and verified violations resulting from any of the above identified conduct will result in disciplinary action that includes a written warning and/or a temporary suspension/loss of membership privileges or a permanent loss of membership privileges.
Enforcement Structure for Violations of Rules by members and/or their guests –
A Board hearing will be conducted for violations that warrant enforcement of clubhouse rules for a member’s or a guest’s infractions. These hearings will be held in Private sessions.
A Letter of Warning citing Violations will be given to all members that commit violations to clubhouse rules. The following is a guideline identifying the suspension of privileges that may be enforced by the Board of Directors.

Conduct violations shall require one or more witnesses to file a complaint with the Board and will result in a letter and/or warning. Any suspension of clubhouse privileges will be determined by the Board after a thorough investigation.

General Rules & Regulations
- Only members and their guests are permitted use of YECC facilities.
- Guests will be allowed use of YECC facilities provided they are accompanied by a host member and signed in as a guest by the host member. Guests are not members of the same household as Club members who have chosen not to join the Club as members.
- The Clubhouse is open to the membership 24 hours a day 7 days a week. (Members using The Club after 8:00PM are responsible for ensuring the pool/hot tub is re-covered (if applicable), the access doors of the club are closed and secured, and the lights are turned off.
- Key card(s) shall be issued to paid members of the Club only. Any Key cards that may be required for contractor or vendor access to perform routine services at the clubhouse shall be determined as necessary and approved by the board before issuing.
- There shall be NO SMOKING in any part of the clubhouse or on clubhouse grounds.
- There shall be NO PETS / ANIMALS ALLOWED in the Clubhouse or on the grounds of the Club except Certified Service Dogs / Pets.
- There shall be NO PARKING in the front driveway or on sidewalks around the clubhouse, except for loading and unloading. Bicycles shall be parked in the bicycle racks only. Motorbikes shall be parked on the east side of the clubhouse near the bicycle racks.
- Recreational Vehicle parking for members shall be allowed in the gravel parking lot for members of the clubhouse. Parking will be limited to no more than 24 hours. This parking shall be for the convenience of members needing time to situate their Recreational vehicles on their property before or after traveling.
- CLUBHOUSE EQUIPMENT shall not be removed from the clubhouse, and outside recreation equipment belonging to The Club shall not be removed from the grounds of The Club. Personally owned equipment or other property shall not be stored in the clubhouse or on the clubhouse grounds.
- Members (individual members and organized groups) using the CLUBHOUSE, ITS FACILITIES, AND/OR THE GROUNDS, shall be responsible for leaving them in a neat and clean condition so that the next member to use them may do so without having to first clean up after the previous member. This includes returning club equipment to proper storage areas after use.
- Use of the BULLETIN BOARDS shall be for Club activities and notices pertaining to Club members only unless previously approved by the Secretary of the Club.
- Sexual harassment, any deliberate act that interferes with another’s use of the Clubhouse Areas, and/or harassment of individuals of any nature or form; the use of offensive language or profanity, and/or the conduct of one's self in an offensive, suggestive, or rude manner while on or in any Clubhouse Area, is strictly prohibited.
Guest’s Rules & Regulations (See general rules above about the definition of guests)
- The following rules are hereby established for use of the Club by GUESTS OF MEMBERS. Guests will adhere to all of the rules of the clubhouse for members.
- Members who bring GUESTS into the clubhouse shall accompany them while at the clubhouse and sign them in at the front desk each time they bring them into the clubhouse. MEMBERS shall be responsible for the GUEST'S conduct while using the club facilities.

- There shall be NO RUNNING or any horseplay in the pool areas.
- An OUTSIDE SHOWER shall be taken by all persons before entering or using any pool facilities.
- BODY LOTIONS, SUNTAN LOTIONS, and BODY OILS shall be prohibited from use before showering or entering any pool. Only water-soluble sunscreen may be used and must be applied at least 45 to 60 minutes before entering the Pool area. NO OILS.
- SHAMPOO and SOAP shall be prohibited in outside showers.
- DIVING and JUMPING into any pools or the hot tub is prohibited.
- TOYS and FLOTATION DEVICES shall be prohibited in pool areas, except for small personal flotation devices, such as the Noodle, and Coast Guard approved life vest. If personal flotation devices interfere with swimming, they shall be removed from the pool.
- LAP LANES are reserved for lap swimmers but may be used for general swimming when not being used by lap swimmers or when used for scheduled water activities.
- GLASSWARE shall be strictly prohibited in pool areas.
- Eating and drinking are only allowed in designated Pool areas. Each person is responsible for depositing all trash and cans in trash containers.
- CHILDREN / INDIVIDUALS UNDER 18 YEARS OF AGE may use the pools only during the following established hours:
- Children under age 18 shall be prohibited from using the HOT TUB use at all times.
- Children may use the Lap Pool only for the purpose of swimming laps.
- Pool hours for visiting Children: Conversation and Lap Pools - 10:00 a.m. - 2:00 p.m. and 6:30 p.m. - 10:00 p.m.
- Children who have not been DIAPER TRAINED or toilet trained shall be prohibited from using any pool. Children (up to age 18) must be accompanied by the club member they are visiting during all times in the clubhouse.
- Persons with open cuts, sores, rashes or wearing adhesive bandages are not permitted in the Pools or hot tub.
- No portion of any Pool equipment may be used for anything other than the intended purpose. By way of clarification and not of limitation, no person shall be permitted to use the railings / ladders in Pools for any purpose other than for the entry or exit from the related Pool. Moreover, no person shall situate himself or herself in a Pool that impedes or interferes with anyone else entering or exiting a Pool from an intended entry or exit point.
